Paternity
Hawaii law considers the husband to be the
legal father of all children born during the marriage. If the
husband believes that a child born during the marriage is not his,
he may seek to establish paternity before the divorce is final. If
paternity is not
established, the husband will remain the legal
father and will be legally responsible for the child. A paternity
action is a court order that establishes who the legal father is. A
legal father has certain rights (primarily, rights regarding custody
and visitation) and obligations (to pay child support if he doesn’t
have physical custody).
