Hawaii Paternity
Regarding a child born during the marriage,
Hawaii law "presumes" that the husband is the
legal father of the child. If the
husband or wife believes that a child born during the marriage was
not fathered by the husband,
either party may seek to establish or disestablish paternity before the divorce is final. If
paternity is not
timely established
or disestablished, the husband will remain the legal
father and will be legally responsible for the support, maintenance,
health, and education of the child. A paternity
action is a court process which results in a court order establishing
the identity of the father. A
legal father has certain rights (primarily, rights regarding custody
and visitation) and obligations (to pay child support if he doesn’t
have physical custody).
